Terms and Conditions
Last updated 23 October 2026. These pages apply to e-SOS at https://www.e-sos.icu, the app at https://app.e-sos.icu and the API behind them.
These Terms and Conditions ("Terms") are an agreement between you and the operator of e-SOS ("e-SOS", "we", "us", "our"), contactable at support@e-sos.icu. By creating a household, using the app at https://app.e-sos.icu, the website at https://www.e-sos.icu or the API, you agree to these Terms. If you do not agree, do not use e-SOS.
1. What e-SOS is — and what it is not
e-SOS is a family personal-safety app. One press sends an alert to the circle of people you chose, with your location, optional photo and audio evidence, your home address as five short words, and a bounded live-map Follow window. A server-side welfare timer can alert your circle when you miss a check-in.
e-SOS is not an emergency service. There is no call centre, no monitoring station and no guaranteed response or delivery time. Alerts ride networks and third parties (mobile networks, WhatsApp, e-mail) that can be slow, congested or down. In an emergency, always call your local emergency numbers yourself — they are one tap away on every alert.
2. Eligibility and accounts
You must be 18 or older to create a household. Give accurate information, keep access to your e-mail safe — sign-in works through one-time links sent to your mailbox, and there are no passwords — and protect your devices. API keys you mint for assistants are shown once and act with your authority; revoke them in the app when they leak or the assistant no longer needs them. You are responsible for everything done through your account, your devices and your keys.
3. Your circle and other people's details
You choose who receives your alerts. Before you add someone's WhatsApp number or e-mail address, make sure they are happy to receive alerts from you — they will be asked to accept on their own page before anything is ever sent to them, and every message they receive carries a one-tap leave link. Do not add people who have not agreed, and never use e-SOS to monitor, track or harass anyone.
4. Location, evidence and recording
Your location is shared only when you press the button or start a Follow window yourself, and a window never runs longer than 60 minutes. Photo and audio evidence is captured on your device while you hold the button (you can switch each stream off). You agree to capture and share evidence lawfully, and only with the people your alert reaches. Follow windows and their trail exist only while you choose to share them.
5. Fair use
Do not send false or prank alerts; do not use e-SOS for unlawful surveillance, stalking or harassment; do not interfere with the service, circumvent its rate limits, or use the API and agent surface except as documented. We may suspend or end accounts that break these Terms or the law.
6. Plans, payment and billing
The free plan includes the full panic button with a smaller circle. The Family plan (currently $1/month or $10/year) adds more members, more contacts, live location sharing, hourly check-ins, saved places, longer evidence history and webhooks, as described on the pricing page. Payment is collected through Whop; their checkout and terms apply to the payment itself, and we never see your card details. If a payment lapses, your household returns to the free plan and the button keeps working — nothing is switched off mid-emergency. Cancel or change your plan through Whop.
7. Third-party services
e-SOS relies on others to reach your circle and draw its maps: WhatsApp (Meta) and e-mail for delivery, OpenStreetMap, Esri and CARTO for map tiles, Tlhano for five-word addresses, Whop for billing, and the security control room you choose to link. Their own terms govern their parts of the service, and an outage on their side can delay or stop an alert.
8. Availability and changes to the service
e-SOS is provided "as is". We work hard to keep it available, but we may change, suspend or discontinue features. If a change is material we will say so in the app or on the website.
9. Ending the agreement
You can delete your household at any time in the app (Settings → Delete). We keep only the audit trail as our safety and legal record, as described in the Privacy Policy. We may suspend or end an account for abuse, unlawful use or non-payment, with notice where that is practicable.
10. Disclaimers
Except for the rights the law gives you (including South Africa's Consumer Protection Act, where it applies), e-SOS is provided without warranties of any kind — express or implied, including fitness for a particular purpose. We do not warrant that alerts will be delivered, that the service will be uninterrupted, or that third-party lanes will perform.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, special or consequential loss — including lost data, emotional distress, or the consequences of an alert that was delayed, altered or not delivered by third-party networks. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim or US$10. Nothing in these Terms limits liability for death or personal injury caused by our negligence, or anything else the law does not allow us to limit.
12. Governing law
These Terms are governed by the law of South Africa. We handle personal information under South Africa's Protection of Personal Information Act (POPIA) and, where it applies to you, the GDPR. If there is a dispute, talk to us first — most problems are solved by e-mail — and otherwise the competent South African courts decide.
13. Changes to these Terms
We may update these Terms; the "last updated" date above changes with them. Material changes are announced in the app or on the website. Using e-SOS after a change takes effect means you accept the updated Terms.
14. Contact
Questions about these Terms: e-mail support@e-sos.icu, use the contact form at https://www.e-sos.icu#contact, or ask Jax on WhatsApp or in the app.
